April 8, 2019It has been a Registrar’s Requirement to lodge almost all Transfer dealings at Land Use Victoria using an electronic settlement system since 1 October 2018. That means virtually all settlements in Victoria are now conducted electronically.
Exceptions to this requirement include lodgement of those Transfers whose stamp duty cannot be assessed in Duties Online, examples of this are:
- Sales of land involving Water Rights or farm equipment.
- Sales involving Aggregation, i.e. multiple sales from the same seller to the same buyer at the same time.
- Transfers into or out of superannuation funds or other trusts.
- Partition transfers, between the joint owners of subdivided land.
The Transfers in these exceptional cases are prepared on paper (i.e. the old way) and lodged manually at Land Use Victoria after their stamp duty (if any) has been assessed by the State Revenue Office.
